Trading Conditions

§ 1. General

Being inferior general trading conditions are valid for contracts, deliveries and other accomplishments. We objekt principally different agreement conditions fixed by our business partners. All additional agreements must be recorded and confirmed from our company.

§ 2. Offers

Our offers are non-binding. Minimal divergences and technical changes compared to our immages or descriptions are possible. The current catalogues loose its validiy with publication from the new ones.

§ 3. Sale an delivery

The terms of sale and delivery are described in the price catalogue of ULRICH PERATHONER KG-SAS. There is not a minimum order for resellers. All our prices are specified without the legal VAT. We reserve us to do a part delivery, when this appear favorable for a quick transaction. Delivery costs will be invoiced for all shipments, standard packing costs are undertaken from us. Special packing costs will be invoiced.

§ 4. Delivery time

Products on stock will be delivered immediately, or at the agreed date. Products not on stock will be delivered as soon as possible. For a non-compliance of a delivery- or accomplishment time limit caused by force majeure, industrial action, unpredictable encumbrances or other not representable circumstances, the time limit will be extended appropriate. Damages for delays, impossibility or non-fulfilment, also such, that brings to the rescission of the contract are excluded. Unless a legal rapresentant of the company ULRICH PERATHONER KG-SAS has acted wilful or careless.

§ 5. Right to return

We guarantee for the goods a right to return within 8 days, only with written form complait within this time limit. The time limit will be ensured with the in time sending of the goods (invoice date). The sending back will be accepted from us only if its sufficient post-paid.

§ 6. Transfer of risk

With the delivery of the goods the danger goes from the ULRICH PERATHONER KG-SAS to the buyer.

§ 7. Warranty

ULRICH PERATHONER KG-SAS warranties, that the sold products at the time of transfer of risk was free from material defects and has the attributes assured in the contract.

§ 8. Reservation of proprietary rights

The goods remain property of the ULRICH PERATHONER KG-SAS company until the full payment is fulfilled.

§ 9. Data storage

About Art. 10 Ges. Nr. 675/96 and following changes you will be informed, that the data that you provide us will be used only for that purpose and in comply with the law.

§ 10. Court of jurisdiction

Place of performance and court of jurisdiction for both parts ist the court of jurisdiction Bolzano - Italy. It´s valid only the italian law.
